Trial to Decide ‘D&D’ Movie Rights Begins

The trial to decide who owns the movie rights to Dungeons & Dragons opened in federal court in Los Angeles last week, with the two sides introducing their cases, as reported by Deadline and ICv2.com. The case, which began in May 2013, will turn on the question of whether Sweetpea Entertainment, which had the D&D movie license since TSR was an independent company (two acquisitions ago), satisfied the “use it or lose it” clause in the contract with its 2010 Syfy movie based on Book of Vile DarknessDungeons & Dragons owner (Hasbro subsidiary) Wizards of the Coast moved to suit when it looked like Sweetpea was going to make a film with Warner Bros. based on Chainmail, a precursor to D&D.

The judge ruled that Chainmail would have been an infringement had it been made, but in the meantime Sweetpea signed a multimillion dollar deal with Warners to make a new D&D movie this summer.  Warners even kicked in around a million dollars for legal fees in the battle with Hasbro, which wants to make a movie with Universal, making this what Deadline called a “proxy war” between Warner Bros. and Universal.

It looked for a while like the two sides were moving toward a settlement, but talks apparently broke down and the case was scheduled for trial.

The two sides presented their positions on last Tuesday (i.e., Book of Vile Darkness is/was not a film sequel), and in the process got in an exchange about Hasbro/Wizards of the Coast’s plans for the property if it prevailed.  Hasbro wants the rights back so it can “sell it to their new best buddy, Universal,” Sweetpea’s attorney argued; but “Hasbro has no agreement with Universal,” Hasbro’s attorney replied.  That’s surprising, given that Hasbro said back in 2013 that it had a D&D movie set up at Universal with Chris Morgan to direct.  Hasbro does have an umbrella deal with Universal.

Game of Thrones Writer to Pen Script for ‘Magic the Gathering’ Film

Earlier this week it was announced on Deadline.com that 20th Century Fox has selected Games of Thrones writer Bryan Cogman – also a producer, story editer and writer for the insanely popular HBO drama – to pen the script for the planned ‘Magic the Gathering’ film, produced by Hasbro and 20th Century Fox.

Fox acquired the rights to the ‘Magic the Gathering’ film last January, a trading card game released in 1993 by Wizards of the Coast – now owned by Hasbro. Since 1993, ‘Magic the Gathering’ has become one of the most successful games in the hobby industry to date.

 

Simon Kinberg, the producer attached to the project, is best known for X-Men: Days of Future Past  and Sherlock Holmes.

LOS ANGELES, Calif. & PAWTUCKET, R.I. January 14, 2014 — Twentieth Century Fox and Hasbro, Inc. (NASDAQ: HAS) have joined forces to make a series of films based upon Hasbro’s Wizards of the Coast’s fantasy-adventure property, MAGIC: THE GATHERING.  Simon Kinberg (X-Men: Days of Future Past), whose Genre Films banner is based on the Fox Lot, will serve as the franchise’s creative steward and produce in close partnership with Hasbro.

 

The announcement was made today by TCF production president Emma Watts, and Stephen Davis, president of Hasbro Studios.

 

MAGIC: THE GATHERING is the world’s best strategy game, creating endless worlds and compelling characters that resonate with more than 12 million players and fans worldwide. As Hasbro’s number one game brand, and one of the biggest fantasy properties in the world, the global powerhouse offers tremendous potential for the film franchise.

 

Hasbro President & CEO Brian Goldner, Stephen Davis and Wizards of the Coast President Greg Leeds will produce the franchise together with Genre Films execs Aditya Sood and Josh Feldman.  Fox creative executives Kira Goldberg and Ryan Jones and Hasbro Studios’ executive Daniel Persitz were integral in making the deal and will be overseeing development of the films.

Battle Over ‘Dungeons & Dragons’ Movie

Well boy’s and girls, it looks as if it is going to be a long time before we are allowed to enjoy another Dungeons & Dragons film.

 

According to ICv2.com, Sweetpea Entertainment filed suit for a partial dismissal of the infringement suit filed by Wizards of the Coast against Sweetpea regarding its plans for a film based upon the Dungeons & Dragons franchise. The planned Warner Bros. film is to be based upon D&D  precursor Chainmailnot Dungeons & Dragons, the motion alleges.

 

Evidently, the Warner Bros. film with Sweetpea is one of two planned Dungeons & Dragons films. The other, by Universal Studios, is currently in the works with Wizards of the Coast parent company Hasbro. Additionally, Sweetpea likewise filmed suit last September to block the Universal Studios film.

 

Trial is set for March 24, 2014.

 

So Dungeons & Dragons fans, be patient – looks like it is going  to be a while before we enjoy a new Dungeons & Dragons film. However, if it is anything like the 2000 film Dungeons & Dragons starring Jeremy Irons and Thora Birtch, we can wait.
